At the October 27 meeting, the County attorney confirmed that Sumter County’s existing landfill lawsuit does not address the proposed deep injection well or aquifer concerns. It addresses odors and permit compliance.

She also explained that limited regulatory authority does not prevent the board from considering potential civil litigation concerning the well, if supportable claims are identified.

I asked for:
• A public response to my October 16 request to evaluate possible remedies under RCRA.
• An independent review of potential groundwater risks and public notice.
• A clear explanation of the County’s remaining options and next steps.

Commissioners requested additional legal research, contact with Lake County, and a meeting to discuss further action.

That is progress. Now we need a public report back—with findings, decisions and dates.

No new injection-well lawsuit or opposition resolution was approved during this discussion.

Update — October 29, 2026

WUFT reported on requests for additional litigation. This does not establish that a second lawsuit has been filed. The existing odor case and possible injection-well action are distinct.
